1. Introduction
In this essay I want to deal with the topic of data protection in Europe and all the problems around it. In the first step I will analyze the actual situation concerning national and supranational laws and then I will try to give a prospect for future developments in data protection in Europe. First of all we have to clarify, how important data protection is for every single country and for supranational unions like the EU, and with which interests data protection may collide. Data protection is a quite recent development, which is related very closely to the development of the computer. From about 1970 on computers were used in more and more professional and private areas, and so data protection became important for each individual. In the beginning data protection was a subject of only national interest. Several European nations, among them also Austria, passed laws for data protection. But soon it was clear, that with increasing economic relations, the data exchange between the nations was growing. Finally the importance of supranational regulations for the specific problems of data protection could not be denied any longer. Therefore in September 1980 the Organization for Economic Cooperation and Development (OECD) established guidelines in order to protect privacy in supranational data exchange. Almost at the same time (1981) the Council of Europe established a convention for the protection of personal data concerning electronic data processing. Moreover the European Community, or better said the European Parliament started to discuss this topic. When in 1987 the free internal market in the EC was established, free data transmission within the participating countries should also be possible. In 1992 the Treaty of Maastricht added another very important regulation. The nations who signed the treaty, agreed on a very close cooperation concerning internal security and data exchange for police purpose. With help of this agreement, and also with the Schengen Information System (SIS) signed in the Treaty of Schengen, the European Police (Europol) supranational inquires.
