Discrimination Against Women in the Workplace
In the United States, gender discrimination is one of the most common types of discrimination. The evolving role of women in the workplace is not readily accepted in society. Despite the illegality of gender discrimination, women are being discriminated against in hiring practices, advancement opportunities, and income in the workplace. The U.S. Equal Employment Opportunity Commission (EEOC) enforces federal laws such as Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act of 1967 among other anti-discrimination laws. Employers with 15 or more employees are subject to federal regulations. Employers can receive guidance and technical assistance from EEOC to help them understand their legal obligations concerning equal employment. Oversight and lack of understanding may sometimes be the reason a company violates federal laws. The penalties, fines, costs for litigation and lost time for egregious, intentional discrimination are steep. It is in a company’s best interest to have a qualified, experienced human resources leader on staff (EEOC). The civil rights act of 1964 forbade discrimination on the basis of race as well as sex in hiring, firing, and promoting. Section 703 (a) of the civil rights act made it unlawful for an employer to refuse or fail to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions or privileges, or employment, because of such individual’s race, color, religion, sex, or national origin (Exec, 1991).
While women have made gains in the last four decades, there remain serious barriers to full equality in the workplace. Title VII has been one of the main tools for tackling these barriers,
helping to root out and eliminate illegal practices. But despite these legal protections, women
continue to face discrimination. Stereotypes and biases about women and their abilities affect
how much women make, limit their career advancement, and impede their efforts to achieve
economic independence and stability. Thus, to make a meaningful assessment of where women are, it is essential to take a comprehensive look at the discrimination women continue to face and
the effectiveness of anti-discrimination enforcement.

Gender discrimination has occurred when: (1) an employee has been treated differently because of his or her gender, (2) an employee has been excluded from consideration or participation in an opportunity because of his or her gender or (3) an employee has been eliminated from certain activities because of their gender. It can be difficult to determine when gender discrimination has occurred because it is not always as overt as other violations such as sexual harassment.
Not long ago there were separate help wanted ads for women and men. For too many women, discrimination still plays a role in the jobs they get, the wages they are paid, and the promotions they receive. Whether it is unwelcome sexual advances on the job, gender-based pay scales that lower women’s wages, or old-fashioned attitudes about pregnancy or certain racial or ethnic communities, many women still work in unfair environments that make it difficult for them to succeed.
