Hukum mencuriDi dalam Islam, hukum mencuri ditegaskan di dalam Al-Quran:
'Laki-laki yang mencuri dan peempuan yang mencuri, potonglah kedua tangannya (sebagai) pembalasan bagi apa yang mereka kerjakan dan sebagai siksaan dari Allah. Allah Maha Perkasan dan Maha Bijaksana' (Q.S. Al Maidah (5) : 38 ).
Nabi Muhammad SAW juga pernah bersabda tentang bahaya mencuri bagi suatu masyarakat dan ketegasan hukumnya:
'Demi Allah! Kalau sekiranya Fatimah binti Muhammad yang mencuri, pasti akan kupotong tangannya.' (Riwayat Bukhari)

" Dalam kisah lain disebutkan ada dua orang hamba sahaja yang mencuri dari tuannya karena tidak diberi makanan yang cukup, Umar tidak menghukumnya, tapi justru mengancam akan memotong tangan tuannya. . Kisah serupa juga bisa didapati pada suatu kisah ketika beberapa budak milik Hathib bin Abi Balta'ah mencuri seekor unta kepunyaan tetangga, dan menyembelihnya. Umar bin Khattab menerima pengaduan tetapi tidak segera menjatuhkan hukuman melainkan lebih dahulu bertanya kepada budak-budak itu tentang sebab-musabab mengapa sampai mencuri. Ternyata mereka benar-benar terpaksa untuk mengisi perut karena ditelantarkan oleh majikannya. Umar benar-benar marah, Hathib segera dipanggil dan dipaksanya untuk mengganti unta yang dicuri budak-budaknya. Sementara budak-budak itu sendiri ia bebaskan dari segala tuntutan.
Ini menunjukkan bahwa dalam pelaksanaannya hukum itu melihat konteks atau pre-kondisinya. Setiap keputusan hukum memiliki apa yg disebut sbg 'illat (sebab, rasio-logis tentang kenapa hukum itu ditetapkan). Jadi kalau pre-kondisinya tidak terpenuhi maka hukum itu tidak bisa dijalankan.
Bahkan lebih jauh lagi, Yusuf Qardhawi dalam bukunya Malaamihu Al Mujtama' Al Muslim Alladzi Nasyuduh (ditermahkan dalam Sistem Masyarakat Islam dalam Al Qur'an & Sunnah), berpendapat bahwa pelaksanaan hukum Islam sebenarnya cenderung untuk menutupi dan memaafkan hukuman sebagaimana dikenal dalam kaidah popular "Dar'ul Hudud bisy-syubahaat", yang artinya menolak hukuman dengan adanya syubuhat (kemungkinan-kemungkinan untuk membatalkan). Ada sebuah hadist yang berbunyi:
"Tolaklah hudud itu dari kaum Muslimin semampu kamu, jika kamu mendapatkan jalan keluar untuk seorang Muslim maka lepaskanlah jalannya, sesungguhnya apabila seorang imam salah dalam memaafkan, itu lebih baik daripada salah dalam menghukum." (HR. Hakim)
Hadist ini diperkuat dengan hadist : "Tolaklah hudud itu dengan syubuhat."
Kasus pembebasan pencuri oleh Umar, menurut Qardhawi menunjukkan penerapan hal ini. Ini bukan bentuk mengugurkan hukuman tapi karena pre-kondisinya belum wajib untuk diterapkannya hukum itu. Seperti tidak wajibnya suatu perintah karena sebelum memenuhi seluruh rukun dan syaratnya.

Hak publik, seperti kewajiban negara untuk melindungi rakyatnya;
