APA ITU TALAK?
Talak menurut bahasa bermaksud melepaskan ikatan dan menurut syarak pula, talak membawa maksud melepaskan ikatan perkahwinan dengan lafaz talak dan seumpamanya. Talak merupakan suatu jalan penyelesaian yang terakhir sekiranya suami dan isteri tidak dapat hidup bersama dan mencari kata sepakat untuk mecari kebahagian berumahtangga. Talak merupakan perkara yang dibenci Allah s.w.t tetapi dibenarkanAl-Qur’an:

Ini karena bentuk pengungkapan cerai dalam Alquran harus dengan cara lisan, bukan tulisan.
Majelis Tarjih Muhammadiyah dalam Fatwa Tarjihnya pada hari Jum’at, tanggal 8 Jumadil Ula 1428 H / 25 Mei 2007 M memutuskan bahwa: talak harus diucapkan di depan persidangan Pengadilan Agama. Sehingga talak dalam bentuk ucapan maupun tulisan seperti SMS yang dilakukan di luar persidangan hukumnya tidak sah.
Majelis Ulama Indonesia sebagaimana hasil sidang ijtima’ Majelis Ulama Indonesia pada tanggal 1 Juli 2012 di Tasikmalaya: bahwa talak yang terjadi di luar persidangan (baik tulisan atau ucapan) harus dilaporkan di depan persidangan. Artinya jika menurut majelis hakim yang mengadili tidak memenuhi salah satu alasan perceraian, maka talak tersebut tidak sah.

Talak dilihat dari cara menjatuhkannya dibagi menjadi dua macam: Sharih dan Kinayah. Sharih artinya jelas yaitu dengan menggunakan kata talak atau cerai. Sedangkan kinayah artinya itu sindiran seperti “aku mengembalikan kamu pada orang tuamu”. Mayoritas ulama sepakat bahwa selama disertai niat, maka baik talak yang dijatuhkan dalam bentuk sharih maupun kinayah hukumnya sah.

Lalu bagaimana jika talak disampaikan melalui sms? pendapat para ulama di atas mengenai hal ini sangat beragam dan tentu sangat membingungkan bagi kita untuk mengikuti madzhab yang man. Jika kita merujuk pada pendapat MUI dan majelis Tarjih Muhammadiyah, maka talak yang dijatuhkan melalui SMS hukumnya tidak sah karena tidak diucapkan di hadapan persidangan pengadilan Agama.
