Intermediate sanctions are methods of punishment as well as rehabilitation, and the long-term benefit should be more satisfying than for someone who has not gone to prison. With caseloads becoming too much for prosecutors to handle, these sanctions can help restrict the movement of the offender without wasting the money that normally is spent to incarcerate an offender. It also provides an easier, and successful means of supervision for the overworked probation officers.
Studies and research have found that intermediate sanctions are positive. Despite that some not initially recognizing that intermediate sanctions reduced recidivism. The key is to ensure the utilization of programs for the right kinds of offenders, and that intense enforcement of conditions does not hinders minor offenders into very punitive sanctions. The guidelines for intermediate sanction are guidelines that can be disregard when a case warrants different treatment from the norm (Tonry, 1997), as in the case of the young man. He is not a criminal, but a victim of physical and mental abuse that requires help instead of punishment.

The judge in this case chose probation for the offender because of the information and agreements presented in trial. Therefore, the team agrees with the probation officer’s recommendations relating to intermediate sanctions. A probation officer thoroughly evaluates each offender to determine which sanctions best fits an offender’s needs. The probation officer supervises the offenders on his or her caseloads to keep him or her on the right path of rehabilitation. A probation officer also conducts home visits, determines if an offender is following the probation guidelines, or verifies if a person is working. A probation officer receives the proper training to determine what types of sanctions will benefit the offender, and the community. He or she also makes sure the offender provides restitution for his or her crimes.
The probation officer in this case recommends intermediate sanctions because of the circumstances involving this case. If the suspect were defending himself at the time of the murder intermediate sanctions are appropriate for the crime. The probation officer may recommend counseling, and intensive supervision. Counseling will help the offender heal by discussing the abuse, and his experiences growing up. The intensive supervision procedures will make sure he is not committing new crimes. However, if the suspect planned to kill his stepfather because of childhood abuse, intermediate sanctions are not the proper options for his crime. Consequently, the suspect needs to serve his time in prison because of premeditation. While in prison, he needs to receive counseling, and mental health treatment. The mental health treatment will help him get the mental evaluation he needs to treat whatever illness he may have.
