Social Media continues to grow in today’s society. With its added growth companies and managers need to be fully aware of the business that they conduct online. They also need to be concerned with jurisdiction and how that may affect the business. In the event of an issue the company should be informed about alternative dispute resolutions. The second component that the legally astute manager needs to address is to have a proactive approach to legal issues and regulations (Bagley p.11). The manager should consistently monitor online transactions. Monitoring the sites should help identify any issues or inconsistences fairly early. Addressing these potential issues early, allows the company an
opportunity to research the issue and try to have a resolution before the issue has an opportunity to become a legal issue. In order to be proactive the manager has to already have an understanding of the laws and any legal ramifications. With conducting business online the manager would need to be an aware of issues such as shipping issues, and customer complaints. The manager would need to satisfy the customer before the customer seeks litigation.
The third component is the ability to exercise informed judgment when managing the legal aspects of business (Bagley p.11). If a customer notifies the company that they never received the product or that the product was damaged upon delivery, the legally astute manager would have to know what the company’s response should be. Does the company have a legally obligation to ship out another product? Does the company put the blame and responsibility on the shipping company? Are there any other alternatives to resolving such issues?
The final component that the manager would need to be aware of and focus on is having specific knowledge of the law and the appropriate use of legal tools (Bagley p.11). The manager needs to know and be fully aware that the same consumer protection laws that affect standard businesses are still pertinent with any online advertising and transactions. Essentially the manager should be completely knowledgeable of the Federal Trade Commission Act. This Act was created to protect consumers from unfair and deceptive business practices. The manager would also need to make sure that all disclosures should be clear and concise.
There are a few different methods of resolving a dispute between the business and consumer without having to go through the court system for resolution. Alternative Dispute Resolution (ADR) can be a more beneficiary method of resolving a dispute as it addresses several issues. One of the benefits of ADR is that the procedure can help maintain a positive relationship between the company and the consumer. Another benefit of ADR is that it is usually less expensive than going through court proceedings, which is a win/ win situation for both the company and the consumer.
